APPROVAL OF MINUTES
Mayor McCourt called for additions, corrections or changes to the Regular Meeting Minutes of September 21, 2010, the Special Public Hearing Meeting Minutes of September 28, 2010 and the Emergency Meeting Minutes of September 29, 2010. All minutes were approved as distributed.
COMMENTS, QUESTIONS, PETITIONS, ETC. FROM THE PUBLIC
Kenneth McClendon 13140 Northview Heights Court. Mr. McClendon advised that his property backs up to Harold Evangelista Park. His neighbor witnessed someone hopping over his fence to access the park and that someone removed his 4ft fence and cut down 6ft of brush behind his property. Officer Curry verified that Mr. McClendon’s fence was found in a dumpster in the park. Mr. McClendon advised he would like the City to replace his fence and a letter stating the issue of people using his yard to access the park would be addressed.
Mayor McCourt advised that at this time there is no proof that the City removed the fence or cut down the brush. City Hall was closed on the day in question, which is Friday. He advised that he would look into the matter.

OFFICIALS
Councilman Allen provided a correction for free flu shots. Christ Our Redeemer Church located at 13820 Old Jamestown Road will be offering free flu shots on Saturday, October 23rd at 3:30 pm.

Councilman Hinkle moved to postpone the second reading of Bill #1095, entitled, AN ORDINANCE AMENDING SECTIONS 20-353 and 20-354 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK JACK, MISSOURI PERTAINING TO PARKING OF VEHICLES. Motion was seconded and passed when a poll of the Council produced the following vote:

Mayor McCourt discussed a previously distributed letter concerning the vetoing of Bill #1094. He advised that the purpose of the veto is that the amendment to the Bill to change the year from 2010 to 2011 was in error.

NEW BUSINESS:
Bill #1091, entitled, AN ORDINANCE AMENDING SECTION 20-341 OF THE CODE OF ORDINANCES OF THE CITY OF BLACK JACK, MISSOURI CONCERNING PARKING ON A SIDEWALK AND BETWEEN THE SIDEWALK AND THE STREET IN A RESIDENTIAL DISTRICT was read for the first time.
Councilwoman Muller moved to amend Bill #1091 by deleting from line 38 the words “a sidewalk and/or” and line 39 by deleting the words “and street”. Motion was seconded and passed when a poll of the Council produced the following vote:

MISCELLANEOUS:
1.
Mayor McCourt explained that the City receives the assessment rolls for the current year from St. Louis County, we then plug the numbers into a formula in a spreadsheet located on the state auditors website. These numbers, minus the current amount on-hand, plus the amount required to make a bond payment next year determines the tax rate. This year, to keep cost at a minimum, the dollar amount provided was for a 6 month bond payment instead the usual two payments within a 12 month period. This allowed the City to set a much lower tax rate. In the past the City provided a number for an entire year, but during a discussion with the auditors it was determined that since our budget year runs from July 1st – June 30tkrobinsonh, we could use six months instead of twelve. With our current economy this was determined to be a better approach.

Mayor McCourt advised that Tree Limb pick up will begin Monday, November 1st east of Old Halls Ferry Road.
3.
Mayor McCourt advised that the Children’s Halloween Party will be held on Saturday, October 30, 2010 at Jamestown Mall from 6 pm to 8 pm.
4.
Councilwoman Muller advised that she is a strong proponent of the petition to present to President Barack Obama to request that Stan Musial be awarded the Medal of Freedom.
