The City Clerk attested to the fact that a quorum was present. Mayor McCourt called the meeting to order at 7:30 p.m.

APPROVAL OF MINUTES
Mayor McCourt called for additions, corrections or changes to the Regular Meeting Minutes of December 21, 2010. The minutes were approved as distributed.
COMMENTS, QUESTIONS, PETITIONS, ETC. FROM THE PUBLIC
Aulderay Fields – 12913 High Crest. Ms. Fields advised that Councilman White went to her home and observed an unsteady area in regards to icy streets. Councilman White returned the next day and assisted her with the situation. Ms. Fields asked if the City had procedures in place for such instances. Mayor McCourt explained the snow plowing procedures and advised that he would visit the area in question. Ms. Fields also advised that Jamestown Ridge and Old Jamestown Road were very icy as well.

MAYOR’S REPORT
1.
Mayor McCourt advised that the Building Inspector’s report was included in the Council packet.
2.
The police report for the month of December was distributed today and will be discussed during the next meeting.
3.
He previously distributed a memo to the City Council advising that he appointed Van Swingler to the North County Community Events Committee.
4.
So far we have had 5 snow storms and have used approximately 200 tons of salt. It may be necessary to purchase more salt since other storms are predicted.
5.
The Municipal League has requested that municipalities donate 10% of their Ameren lighting cost to the League to help fight the Ameren proposal to increase street lighting fees. The City currently pays $3,072.00 therefore 10% would be $30.72. Mayor McCourt suggested that the Council members advise their Trustees of the proposed rate increase. At this time, Mayor McCourt would like to hold off on releasing the 10% to the Municipal League.
6.
During the month of December there were 13 home occupancy permits issued and 9 apartment occupancy permits issued.

1.
Councilman Allen advised that the North County Community Events Committee January 20th meeting has been rescheduled for Thursday, January 27th due to the weather predictions.
2.
Councilman Steigerwald advised that the City of Black Jack did not receive a Park Grant this round.

Councilman Allen moved to place Resolution #110101 under Resolution and assigned Councilman Krank as the sponsor. Motion was seconded and passed when a poll of the Council produced the following vote:

RESOLUTION:
1.
Resolution #101203, BUDGET ADJUSTMENT 2010/2011 was read in its entirety during the December 21, 2010 City Council meeting. Councilman Schroeder moved to place Resolution #101203 on its passage. Motion was seconded and passed when a poll of the Council produced the following vote:

Resolution #110101, SAFETY AND LOSS PREVENTION was read in its entirety. Councilman Krank moved to place Resolution #110101 on its passage. Motion was seconded and passed when a poll of the Council produced the following vote:

MISCELLANEOUS:
Councilman Hinkle advised that in his opinion when the City is being snow plowed, the streets in Ward 3 that have not been dedicated should also be plowed because those residents are taxpaying citizens and it would not cost the City any extra money.
Councilman Hinkle also advised that the City should also consider another alternative for notifying individuals of a possible violation of the Business License Ordinance. He suggested that the person making the complaint should have to produce evidence prior to the City mailing a letter to the individual.
Mayor McCourt advised that if the City plowed streets that have not been dedicated to the City, the City then owns the street; including their flaws and damages. The streets in question are damaged and the City will not accept them.

The City’s business license procedures have been in place for nine years and to date we’ve only had one complaint. Furthermore, Mayor McCourt advised that other municipality’s procedures include sending a police to the resident as opposed to sending a letter asking a question. Mayor McCourt advised Councilman Hinkle that if he had a different suggestion/procedure to follow to present it to the Council for consideration.
Councilman Schroeder suggested that we obtain in writing from the City’s attorney the legal aspect of plowing undedicated streets.
