ROLL CALL

The City Clerk called the roll and the following members were present:

The City Clerk attested to the fact that a quorum was present.  Mayor McCourt called the meeting to order at 7:32 p.m.

APPROVAL OF MINUTES

Mayor McCourt called for additions, corrections or changes to the Regular Meeting Minutes of November 16, 2010.  The minutes were approved as distributed.

COMMENTS, QUESTIONS, PETITIONS, ETC. FROM THE PUBLIC

1.Attral Hairston 13108 Crestwood Bend.  Mr. Hairston presented Mayor McCourt with a document to be filed.  Mr. Hairston explained how he had received a letter from the City Clerk in reference to a City of Black Jack business license.  He advised that he was very unhappy with the process in which the City contact residents who may be operating a home based business without a business license.

Mayor McCourt advised that the letter he received is a form letter and sent to all residents who may be operating a home based business without a business license.  The letter simply request that the resident complete a business license application and pay applicable fees or sign an affidavit advising that they are not running a business from their home.

2.Nacara Kunda 4960 Parker Road.  Mr. Kunda spoke on behalf of Meyer’s Country Cottage and Irish Pub.  He advised that the owner, Mr. Ronald Durns, passed away about two weeks ago and the business will be changing hands in the very near future.  However, they are concerned about a no smoking ban on the restaurant.  He advised that he would present a proposal to the Mayor and Council that is in line with St. Louis County’s smoking ban for further discussion.

3.Robert Werre 4960 Parker Road.  Mr. Werre advised that he is the chef for Meyer’s and if the Pub is not allowed to maintain the restaurant, the bar and allow smoking in certain areas, it will not last and will be shut down. 

MAYOR’S REPORT

Mayor McCourt advised that the Building Inspector’s report was included in the Council packet.

OFFICIALS

Councilman Schroeder stated that someone advised him that they observed horses running loose in Harold Evangelista Park.

1.Bill #1101, entitled, AN ORDINANCE RETAINING THE PROFESSIONAL SERVICES OF HOCHSCHILD, BLOOM & COMPANY, LLP, CERTIFIED PUBLIC ACCOUNTANTS, AS AUDITORS FOR THE CITY OF BLACK JACK, MISSOURI was read for the second time.  Councilman Allen moved to place Bill #1101 on its passage.  Motion was seconded and passed when a poll of the Council produced the following vote:

2.Bill #1102, entitled, AN ORDINANCE ADOPTING THE SECOND AMENDMENT TO DEFERRED COMPENSATION PLAN OF THE CITY OF BLACK JACK, MISSOURI was read for the second time.  Councilman Taylor moved to place Bill #1102 on its passage.  Motion was seconded and passed when a poll of the Council produced the following vote:

PENDING LEGISLATION:

Councilman Allen moved to place Resolution #101201 under Resolution and assigned Councilman Krank as the sponsor and Resolution #101202 under Resolution and assigned himself as the sponsor.  Motion was seconded and passed when a poll of the Council produced the following vote:

NEW BUSINESS:

RESOLUTION:

1.Resolution #101201, entitled, SALARY/WAGE ADJUSTMENTS FOR THE CITY OF BLACK JACK, MISSOURI EMPLOYEES FOR FISCAL YEAR 2010/2011 was read in its entirety.  Councilman Krank moved to place Resolution #101201 on its passage.  Motion was seconded and passed when a poll of the Council produced the following vote:

2.Resolution #101202, entitled, BUDGET ADJUSTMENT 2010/2011 was read in its entirety.  Councilman Allen moved to place Resolution #101201 on its passage.  Motion was seconded and passed when a poll of the Council produced the following vote:

MISCELLANEOUS:

1.Councilman Allen moved to allow Vijay Bhasin, City Engineer to speak.  Motion was seconded and passed by a unanimous voice vote of the Council.

Mr. Bhasin explained that the current mosquito fogging machine is approximately 7 years old, has a life span of about 10 years and is in need of calibration every year prior to use.  The machine Mr. Bhasin is suggesting the City purchase is a larger machine and will allow the City to be fogged within 3 ½ hours instead of 4 ½. He believes that it is in the best interest of the City to purchase a machine now considering the price.

Councilwoman Muller moved to approve the purchase of a mosquito fogging machine from Clarke in the amount of $2,900.00 to be paid from capital. Motion was seconded and passed when a poll of the Council produced the following vote:

2.Councilman Allen moved to appoint Eddie Peterson to the Americans with Disabilities Act Committee/Human Rights Commission.   Motion was seconded and passed when a poll of the Council produced the following vote:

3.Mayor McCourt advised that the Children’s Christmas Party will be held on Saturday, December 11, 2010 at Jamestown Mall from 4 pm – 6 pm.

4.Councilman Allen thanked everyone that gave a donation for the purchase of bikes to be given away at the annual Children’s Christmas Party.  He reminded the Council that a young mother stopped him at the Missouri Municipal League Conference and expressed her appreciation for the Christmas Party and the fact that one of her children was a winner of a bike last year.  Councilman Allen advised that it is a worthwhile event for the children of the entire North County area.
